Mt. Money — Terms of Service

1. Agreement
These Terms of Service (the "Terms") govern your access to and use of Mt. Money — the website at mount.money and any associated applications, APIs, and services (collectively, the "Service") — operated by Mt. Money ("Mt. Money," "we," "us," "our"). By creating an account or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity, and "you" refers to both you and the entity.
2. The Service
Mt. Money is a multi-entity financial management platform that lets you connect bank accounts, view transactions across multiple businesses, and use an AI assistant to answer questions about your financial data. The Service is currently in pre-launch development and is provided to design partners on a free or discounted basis pursuant to separate agreement.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for use by U.S. residents and U.S.-incorporated businesses; we do not currently serve users outside the United States.
4. Your account
You are responsible for safeguarding your account credentials, including any multi-factor authentication factors you enroll. You must notify us at security@mount.money immediately if you suspect unauthorized access to your account.
You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date. We reserve the right to suspend or terminate accounts that violate these Terms or whose information appears to be false or misleading.
5. Bank account connections
The Service connects to your financial institutions through Plaid, Inc. By connecting an account, you authorize Mt. Money and Plaid to access financial information from the relevant institution. Your interaction with Plaid is governed by the Plaid End User Privacy Policy. You may disconnect any linked institution at any time via your account settings.
6. Acceptable use
You agree not to:
- Use the Service to violate any applicable law or regulation.
- Attempt to access another user's data or workspace without authorization.
- Interfere with the Service's normal operation, including by overloading, probing, or attacking the infrastructure.
- Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent applicable law expressly permits despite this limitation.
- Use automated systems (scrapers, bots, etc.) to access the Service without our prior written consent.
- Use the Service to provide a competing service.
7. Your data
You retain ownership of all data you provide or that is retrieved on your behalf (account information, transactions, tags, categorizations, conversation history). You grant Mt. Money a limited, non-exclusive license to host, process, display, and transmit that data solely as needed to operate the Service.
We do not sell your personal information. We do not use your financial data to train machine-learning models, including those of our AI provider. See our Privacy Policy for details.
8. AI assistant
The Service includes an AI co-pilot powered by a third-party model provider. The AI is provided on an "as is" basis and may produce inaccurate or incomplete information. Do not rely on AI-generated content as financial, tax, accounting, investment, or legal advice. Mt. Money is not a registered investment adviser, accountant, attorney, or tax preparer, and the Service is not a substitute for professional advice from qualified professionals.
9. Pricing and payment
Mt. Money is currently in pre-launch and is provided to design partners free of charge or under separate written agreement. When subscription billing is launched, pricing will be displayed at the time of purchase and these Terms will be amended to reflect the billing terms. We will notify you of any material pricing change at least 30 days in advance.
10. Intellectual property
All rights, title, and interest in the Service — including the software, designs, trademarks, and brand elements — belong to Mt. Money or its licensors. These Terms do not grant you any rights in our intellectual property except as expressly stated.
11. Termination
You may terminate your account at any time by emailing privacy@mount.money or by using an in-app account deletion flow when available. We may suspend or terminate your access to the Service if you violate these Terms, if your use poses a security risk, or upon 30 days' notice for any other reason.
On termination, we will delete or de-identify your personal information within 30 days, except where retention is required by law or by ongoing legal process. See our Data Retention and Deletion Policy for details.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY DATA RETRIEVED FROM A FINANCIAL INSTITUTION OR GENERATED BY THE AI ASSISTANT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOUNT MONEY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO MOUNT MONEY IN THE 12 MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify and hold Mt. Money harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS in Spokane, Washington, under its applicable rules, except that either party may bring an individual claim in small claims court if eligible. You waive any right to participate in a class action or class-wide arbitration.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. For material changes, we will provide additional notice — a banner in the Service or an email to your account address — at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
